The Collective Bargaining Process When issues in terms of employment arise, the NLRA requires the unions (labor) and the employers (management) to bargain â€Å"in good faith† on the issues involved until they either agree on a contract or reach a mutually-agreed stand-off, known as an â€Å"impasse.† In the event of an impasse, employers can impose conditions of employment as long as they had previously been offered to the employees before the impasse was reached. In either case, the result is often the prevention of a strike. Contracts agreed to through collective bargaining are mutually binding and, except under extraordinary circumstances, neither side may deviate from the contract’s terms without the consent of the other party. When legal problems arise during collective bargaining sessions, they are resolved by the National Labor Relations Board (NLRB), the independent federal agency assigned to deal with organized labor disputes and to protect the rights of employees by enforcing the NLRA. What Does ‘In Good Faith’ Mean? The NLRA requires both employers and employees to bargain â€Å"in good faith.† But considering the massive number of disputes claiming failures to negotiate in good faith, that go before the NLRB every year, the term is rather vague. While there is no specific list, a few examples of acts that might be found to violate the â€Å"in good faith† requirement include: Refusing to bargain with the other side about valid workplace issues.Changing or disregarding the terms of a signed contract without the consent of the other sideUnilaterally changing terms of employment.Agreeing to a contract with no intention of actually honoring its terms. Good faith disputes that cannot be resolved are referred to the NLRB. The NLRA requires only that unions treat and represent all of their members fairly and equally.   Most unions have specific internal grievance procedures to be followed by workers who believe the union has failed to uphold their rights or otherwise treated them unfairly. For example, an employee who feels the union acted unfairly in refusing to support his or her demands for more overtime hours than agreed to in the existing contract would first look to the union’s grievance procedure for relief. Non-union workers often have no choice but to accept the terms of employment imposed by management or be replaced by employees who will. The legally-ensured right to negotiate empowers employees to seek a more beneficial situation. The collective bargaining process has contributed to higher wages, better benefits, safer workplaces, and improved quality of life for all American workers, whether they are union members or not. On the other hand, collective bargaining can result in a loss of productivity. The bargaining process can take months and require the participation of many, if not all employees during working hours. Watson Electric joins Warren Electric Group's existing Warren Electric Company, Warren Electric Telecommunications-Utility Company, Warren Electric of Louisiana, Warren Electric of Texas, Warren del Caribe and Thompson Real Estate (warrenelectric.com). There are many suggestions that could be given to Warren Electric. One suggestion is that they need to be careful of the huge logistics problem that exists when acquisitions occur. Animal Cruelty Essay Animal cruelty is the crime of inflicting physical pain, suffering or death on an animal. Society has become a dreadful place for animals where humans can no longer be trusted because of their incongruous behaviour. The animals of the world exist for their own reasons; they were not made for humans to abuse and experiment, however, society has become decayed and inhumane. In the poem ‘Foxes among the lamb’ Ernest G. Moll demonstrates how the farmer poisons the foxes and leaves them to suffer and eventually die. When individuals glance at an animal they judge them as aggressive creatures. The visual poster portrays how animals are innocent and vulnerable creatures to society. ‘The Panther’ by Rainer Maria Rilke displays how animals should not be locked up in cages. Animal cruelty, the abominable way humans treat animals, reflects our decaying society, one that seems to be losing its humanity due to the sadistic nature of humans who lack empathy for others. The poem ‘Foxes Among the lamb’ portrays how foxes eat the lamb and how the farmer acts in an inappropriate abhorrent way. This behaviour is illustrated through the metaphor ‘gift’ which demonstrates the poison that the farmer gives to the foxes to die in a beastly bloodcurdling death. Furthermore the personification ‘Half-frightened eagerness of hate’ presents how the farmer is anxious and determined to kill the foxes and how eager the farmer is to manipulate the foxes. The composer’s use of alliteration â€Å"this time then † this proves how the farmer had to pause and pay attention to make sure that the fox had died. Therefore, humans can no longer be trustworthy among animals because of their antagonistic behaviour which imitates our society. Recognising animal rights will result in an individual having deep respect for animals. The visual poster indicates the innocence of animal and why humans should look after them as well as treat them in a respectful way. The background of the poster represents the manifestation of the dog delighted to be free and not stuck in a cage. It also reveals the dog in a park where he could run around and not locked up. The first thing an observer sees on the poster is the salience of the dog that looks harmless, healthy and blithe. When the audience beholds this, their first impression would be to save these helpless animals. The only thing that animals have done to humans is becoming man’s best friend. Finally, close up shot of the dog has been used to show the guiltlessness and exploitation of animals. This effect makes the audience focus their attention on the animal’s expression, to show the significance of animals and the way society has become an appalling place for them. Hence, humans have to earn the respect and treat animal just like the way they would like to be treated because animals too have a soul and emotions. Animal cruelty is locking animals in cages and keeping them as captives to satisfy and amaze people that are sadistic. The poem ‘The Panther’ conveys how a panther is locked up in a cage in the zoo to astonish people and how the panther feels about having no freedom. The use of imagery in the first stanza â€Å"his weary glance from passing by the bars,† portrays how the panther is tired of looking outside and exhausted of waiting for his liberty. Moreover, hyperbole is revealed in â€Å"only to sink and die within his heart. † This emphasis the sadness and reaction of the panther’s being lonely. In stanza two the simile â€Å"The iron bands is like a dance,† this emphasis how the panther is aware of everything around him but he just really wants to get out of the cage and be free. Thus, humans should not steal the freedom of animals because they too have the right to live their own life. In conclusion, humans have become violently atrocious and antipathetic that they no longer can be reliable in the animal world. This is evident in the text ‘Foxes among the Lamb,’ ‘The panther’ and the visual poster. Continuing to abuse animals and trying to manipulate them will only lead to a decayed society because of our irresponsible actions.

I must do two focused tasks, my first task is a product evaluation, for this task I will be evaluating a hairdryer manufactured by Vidal Sassoon. Justification. I picked this appliance because: Ã…Â ¸ It is a commonly used household object. Ã…Â ¸ I have this appliance in my house so I can look at it whilst testing it against my specification. Ã…Â ¸ It is a unisex appliance used by all age groups. Ã…Â ¸ I am interested to find out how this appliance actually works. Ã…Â ¸ It fit's the criteria which is: It must have an element of control. It must have a power source. It must be a technological product. Safety. Plastic is used to make the casing of the hairdryer. Plastic is an excellent insulator which does not conduct electricity, heat and is also waterproof. It will not reshape with high temperatures. The electric element which is housed well inside the hairdryer does not come in contact with wet hair. An additional feature of this hairdryer is that it has an automatic safety cut-off facility. If there is any danger to the user or if it heats up above a certain temperature the trip switch located in the electric meter box switches. There are square shaped grids at both ends of the appliance. These grids prevent hair from the user getting sucked inside the appliance. The grids also prevent dust from getting into the appliance and onto the element. The cable connected to the rear of the handle is well insulated. It is also quite flexible, which help... ...ed into shape. The heating element has to conduct electricity and heat, so it will be made of a suitable metal. This metal element/core, has to be able to be worked into complex shapes. So obviously it is going to be a light gauge metal and the beat conductor of electricity and heat. Through science, I know that copper is the best conductor of electricity, but the disadvantage is that it tends to be expensive. Aesthetics. The overall colour scheme is silver at the nozzle and maroon at the handle. The buttons and wiring are black. The plastic has a shiny high quality finish, it gets this from the compression moulding and the properties of the plastic. The metallic material on the nozzle also has a high quality finish. The shape of the hairdryer is like a hand gun. All the edges on the hairdryer are curved.

Economic factors include economic growth, interest rates, exchange rates and theinflation rate. These factors have major impacts on how businesses operate and makedecisions. For example, interest rates affect a firm’s cost of capital and therefore to what extent a business grows and expands. Exchange rates affect the costs of exporting goods and supply and price of imported goods in an economy. There are economic differences that influence the relationship between the partners at Shui Fabrics. Chiu Wai, operated Shanghai Fabrics LTC located in China, before it became a joint venture with Rocky River Industries in the United States. When the companies became a venture, Chiu Wai became the Deputy General Manager for Shui Fabrics in China and venturing company Rocky River Industries located in US. Ray Betzell who is the General Manager for Shui Fabrics came to China from Rocky River Industries. Many companies who do business in others countries and cultures fail miserably. Managers must do their homework and learn the business ethic and culture lifestyles before even considering venturing into markets in different counties. To me it seems like neither of the managers did their homework and are having problems maintaining the economic factors that influence their company. A developing country is a non-industrialized poor country that is seeking to develop its resources by industrialization. A developed country is a country that has a high level of development according to some criteria such as income per capita and industrialization. Political-Legal factors include discrimination, consumer, antitrust, employment, and health and safety law. They also include how and to what degree a government intervenes in the economy. Specifically, political factors include areas such as tax policy, labor law, environmental law, trade restriction tariffs, and political stability. These factors can affect how a company operates, its costs, and the demand for its products. Political factors may also include goods and serves which the government wants to provide or be provided and those that the government does now want to be provided. Furthermore, governments have great influence on the health, education, and infrastructure of a nation. Political officials are going to be a big part of the team because they have strong influence on economic life in China. Ray must reach out to them and understand their goals. Success will depend on the personal involvement of top executives. The partners differ dramatically in terms of what constitutes an acceptable financial return. Chiu Wai is happy with achieving a 5% to 6% profit and believes he is viewed as a local hero. Upon achieving his goal he feels that he has done a good job for his country morally and for their side of enterprise by creating jobs for close to 3,000 people. He wants to grow the scope of Shui Fabrics and establish a national brand. Ray Betzell wants a 20% ROI and will only consider growth if it improves profitability, has no interest in creating employment unless it improves the bottom line, is considering maybe having to layoff employees to improve bottom line. He wants to improve quality, and sees no benefit to creating a Chinese brand because it views China as a low-cost manufacturing platform rather than a market. Social factors include the cultural aspects and include health consciousness, populations growth rate, age distribution, career attitudes and emphasis on safely. Trends in social factors affect the demand for a company’s products and how the company operates. With this being said, Ray needs to move outside his personal comfort zone as a manager. There seems to be a lack of clear, shared strategy between the two partners. When the company started 10 years ago, Rocky River has launched Shui Fabrics, a 50/50 joint venture between the U. S. extile manufacture and the Chinese company, to produce dye, and coat fabric for sale to both Chinese and international sportswear manufacturers. Intent seemed clear in beginning after many obstacles, considerable red tape and several money losing years the joint venture was fulfilling China expectations and those of local government and party officials. It seems there was once a clear strategy that has been forgotten over the course of ten year s. Another social factor that is different between the partners would be that a profit over 20% return on investment may be perceived as Western exploitation. When it comes to doing business in China, respect for people’s feelings is paramount – this sensitivity that needs to be taken in respect to people’s ‘face’. Face – a cliche, is the currency of advancement. It’s like a social bank account. You spend it and you save it and you invest. And when you take away somebody’s face you take way someone’s fundamental sense of security. Because of China’s history of exploitation by foreign countries who colonized China or raided China for business purposes, particularly in the business sphere, Chinese do not want to be seen culturally as having been ‘had’ by Western usinesspeople. Unfortunately Chiu Wai attitude at Shui Fabrics jeopardizes the success of joint venture investment. As you can see the partners don’t share the same vision or philosophy at Shui Fabrics, the joint venture within China and the U. S. The disparity in viewpoints can dramatically hamper performance. In order for them to make the company succeed they need to come up with a clear, shared strategy that they both can agree and understand. Power Distance is the extent to which a community accepts and endorses authority, power differences and status privileges. In China, social relationships are formal, hierarchical. People mostcomfortable in the presence of a hierarchy in which they know their position andthe customs/rules for behavior in the situation. The Americans social relationships are informal, egalitarian. People mostcomfortable with their social equals; importance of social rankings minimized. 2. Uncertainty avoidance is the extent to which a society, organization, or group relies onsocial norms, rules, and procedures to alleviate the unpredictability of future events. The Chinese are collectivist because they place higher value on groupcooperation and individual modesty. The Americans are individualism because they place higher value on self-reliance. She married fellow student Thaddeus Horatius Caraway in 1902 and moved with him to Arkansas. Her husband practiced law while she cared for their children and the farm. Thaddeus Caraway was elected to Congress in 1912 and women won the vote in 1920: while Hattie Caraway took it as her duty to vote, her focus remained on homemaking. Her husband was re-elected to his Senate Seat in 1926, but then died unexpectedly in November, 1931, in the fifth year of his second term. Appointed Arkansas Governor Harvey Parnell then appointed Hattie Caraway to her husbands Senate seat. She was sworn in on December 9, 1931 and was confirmed in a special election January 12, 1932. She thus became the first woman elected to the United States Senate -- Rebecca Latimer Felton had previously served a courtesy appointment of one day (1922). Hattie Caraway maintained a housewife image and made no speeches on the floor of the Senate, earning the nickname Silent Hattie. But she had learned from her husbands years of public service about a legislators responsibilities, and she took them seriously, building a reputation for integrity. Election Hattie Caraway took Arkansas politicians by surprise when, presiding over the Senate one day at the invitation of the Vice President, she took advantage of the public attention to this event by announcing her intention to run for reelection. She won, aided by a 9-day campaign tour by populist Huey Long, who saw her as an ally. Hattie Caraway maintained an independent stance, though she was usually supportive of New Deal legislation. She remained, however, a prohibitionist and voted with many other southern senators against anti-lynching legislation. In 1936, Hattie Caraway was joined in the Senate by Rose McConnell Long, Huey Longs widow, also appointed to fill out her husbands term (and also winning re-election). In 1938, Hattie Caraway ran again, opposed by Congressman John L. McClellan with the slogan Arkansas needs another man in the Senate. She was supported by organizations representing women, veterans and union members, and won the seat by eight thousand votes. Hattie Caraway served as a delegate to the Democratic National Convention in 1936 and 1944. She became the first woman to co-sponsor the Equal Rights Amendment in 1943. Defeated When she ran again in 1944 at age 66, her opponent was 39-year-old Congressman William Fulbright. Hattie Caraway ended up in fourth place in the primary election, and summed it up when she said, The people are speaking. Federal Appointment Hattie Caraway was appointed by President Franklin D. Roosevelt to the Federal Employees Compensation Commission, where she served until appointed in 1946 to the Employees Compensation Appeals Board.
